These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Matchmaker App ("Matchmaker," "we," "us," or "our") governing your access to and use of the Matchmaker mobile application and all related services (collectively, the "Service"). By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
1.1. You must be at least 18 years of age to create an account or use the Service. By creating an account, you represent and warrant that you are at least 18 years old, possess the legal capacity to enter into a binding agreement, and are not prohibited from using the Service under applicable law.
1.2. By using the Service, you represent that all information you provide during registration and thereafter is truthful, accurate, and complete, and you agree to update such information as necessary to maintain its accuracy.
1.3. We reserve the right to verify your age and identity at any time. Accounts found to belong to individuals under 18 will be terminated immediately and all associated data deleted.
2.1. Matchmaker is a community-centered introduction platform that connects individuals through trusted mutual contacts ("Matchmakers") within church and university communities. The Service is not a dating app in the traditional sense — it does not use algorithmic matching or swiping mechanics.
2.2. The Service facilitates introductions but does not guarantee any particular outcome, including but not limited to romantic relationships, engagements, marriages, or any form of personal connection. We are a platform, not a matchmaking service, and we do not screen, vet, or perform background checks on users.
3.1. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.
3.2. You may not create multiple accounts, share your account with others, transfer your account, or use another person's account without their express permission.
4.1. You agree to treat all users with respect and dignity. The following conduct is strictly prohibited and may result in immediate account suspension or termination:
(a) Harassment, bullying, threats, intimidation, or stalking of any user.
(b) Hate speech, discriminatory language, or content targeting any individual or group based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
(c) Sexually explicit, obscene, or pornographic content.
(d) Impersonation of any person or entity, or misrepresentation of your identity, age, or affiliations.
(e) Solicitation of money, goods, or services from other users.
(f) Distribution of spam, malware, or unsolicited commercial communications.
(g) Any activity that violates applicable local, state, national, or international law.
4.2. The Service employs automated content filtering. Content flagged by our filters may be blocked or removed without notice. We reserve the right, but have no obligation, to monitor user content and communications.
5.1. Matchmakers are users who voluntarily facilitate introductions between other users. Matchmakers are not employees, agents, contractors, or representatives of Matchmaker App. They act independently and in their personal capacity.
5.2. Matchmakers agree to: act in good faith when making introductions; only introduce individuals they genuinely believe may be compatible; respect the privacy and preferences of all parties; and refrain from making introductions for commercial gain or with malicious intent.
5.3. Matchmakers receive a trust score based on feedback from introduced parties. A low trust score may result in temporary or permanent restrictions on the ability to make new introductions.
6.1. Introductions expire after 7 days if not responded to by both parties. Both parties must accept an introduction before a private chat is opened.
6.2. Declining an introduction is silent — the other party is not informed of a decline. Compatibility answers are kept private until both parties mutually accept an introduction.
6.3. Chat messages and voice messages exchanged through the Service are stored on our servers. We do not routinely monitor private messages but reserve the right to review them in response to reported violations or legal requirements.
7.1. The Service offers a free tier with limited features and a paid subscription ("Matchmaker Pro") with enhanced features. Current pricing is $9.99 per month or $59.99 per year.
7.2. Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your App Store or Google Play account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
7.3. Cancellation: You may cancel your subscription at any time through your device's App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
7.4. Price Changes: We may change subscription prices at any time. Price changes will take effect at the start of the next billing period following notice to you. Your continued use after the price change constitutes acceptance.
7.5. Free tier users are limited to 3 introduction requests per week. This limit resets each Monday.
8.1. With your explicit permission, the Service may access your device's contact list solely to identify contacts who are existing users of the Service and to facilitate invitations to non-users.
8.2. Contact data is processed on our servers and stored in association with your account. We do not sell, share, or use contact data for any purpose other than the features described in this section.
8.3. You represent that you have the right to share the contact information you provide, and you acknowledge that sharing another person's information without their consent may violate applicable privacy laws.
9.1. The Service collects and processes information about your religious denomination, faith story, and church or community affiliation. This information is classified as "special category data" under certain data protection laws (including Article 9 of the EU General Data Protection Regulation).
9.2. By providing this information and using the Service, you give your explicit consent to the processing of your religious data for the purpose of facilitating community-centered introductions and community features. You may withdraw this consent at any time by deleting the relevant information from your profile or deleting your account.
10.1. The Service, including its design, code, graphics, logos, and all associated intellectual property, is owned by Matchmaker App and protected by applicable copyright, trademark, and other intellectual property laws.
10.2. You retain ownership of content you create (profile text, photos, messages). By posting content on the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content solely in connection with operating and improving the Service.
11.1. You acknowledge and agree that you are solely responsible for your interactions with other users. Matchmaker App does not conduct criminal background checks, identity verification beyond email/social login, or screening of any kind on its users.
11.2. You agree to exercise caution, good judgment, and appropriate safety precautions when communicating with or meeting any user in person. We strongly recommend meeting in public places, informing a trusted person of your plans, and trusting your instincts.
11.3. If you experience any threatening, harassing, or inappropriate behavior from another user, please report it immediately through the App or by contacting us at support@matchmaker.app.
12.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MATCHMAKER APP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
12.2. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
12.3. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
You agree to indemnify, defend, and hold harmless Matchmaker App and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; or (d) any content you post or transmit through the Service.
14.1. Informal Resolution: Before filing any formal dispute, you agree to first contact us at legal@matchmaker.app and attempt to resolve the dispute informally for at least 30 days.
14.2. Binding Arbitration: Any dispute that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in the English language in the State of Maryland, United States.
14.3. Class Action Waiver: YOU AND MATCHMAKER APP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
14.4. Exceptions: Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters related to intellectual property, data security, or unauthorized access.
15.1. You may delete your account at any time from the Profile screen within the App. Upon deletion, we will: remove your profile from public view immediately; delete your personally identifiable information within 30 days; and retain anonymized, non-identifiable data for analytical purposes.
15.2. We may suspend or terminate your account at our sole discretion for violation of these Terms, inactivity exceeding 12 months, or for any reason upon 30 days' notice. In cases of severe violations, termination may be immediate and without notice.
15.3. Active subscriptions will not be refunded upon account termination for Terms violations. If we terminate your account without cause, we will provide a pro-rated refund for any remaining subscription period.
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions.
We may modify these Terms at any time by posting the revised Terms within the App. Material changes will be communicated via push notification or email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
